Terms of Service

These are the terms of working with Haze Websites. They are written in plain English on purpose. If anything here is unclear, ring me on 0447 132 774 and I will explain it before you agree to anything.
The mockup is free and costs you nothing to look at. If you go ahead, the site is $2,150 paid once. You do not pay until the site is finished and you are happy with it. The website and the domain end up in your name. Small edits are free for the first 6 months. There is no lock-in contract and no compulsory monthly fee. The rest of this page is the detail behind that.

1.Who you are dealing with
This website and service is operated by [LEGAL NAME TO CONFIRM: Billy Howard trading as Haze Websites, or the Pty Ltd name], ABN [ABN TO CONFIRM], of [BUSINESS ADDRESS TO CONFIRM], Queensland, Australia.
In these terms, "I", "me" and "my" means Haze Websites. "You" and "your" means the person or business engaging me. Contact: billy@hazewebsites.com.au or 0447 132 774.
2.When these terms apply
These terms apply from the moment you request a free mockup, and they keep applying while I build and hand over your website. They are the whole agreement between us, along with any written quote or scope I send you.
If a written quote I send you says something different to this page, the quote wins for that job.
Nothing here replaces a conversation. If you want something in writing before you commit, ask and I will put it in writing.
3.The free mockup
- The mockup is genuinely free. There is no cost, no deposit and no obligation to go ahead.
- A mockup is a preview of what your site could look like. It is not live on the internet, it is not linked to your business, and nobody else can find it.
- I aim to have a mockup to you within 48 hours of getting what I need from you.
- Until you have paid in full, the mockup stays my property. You are welcome to look at it, sit on it, or say no. You may not take the design, code or layout and have someone else build from it.
- If you say no, that is the end of it. I will not chase you and I will not keep pestering you.
4.Price and payment
- The price for a standard Haze website is $2,150 (AUD), paid once. Haze Websites is not currently registered for GST, so no GST is charged on that price and no GST is included in it. If I become registered for GST, I will say so here and on the invoice, and I will tell existing customers before it affects them.
- There is no deposit. You pay after the site is finished and you have approved it.
- An invoice is issued when you approve the finished site. Payment is due within 7 days of the invoice date unless we agree otherwise in writing.
- Accepted payment methods: [PAYMENT METHODS TO CONFIRM: bank transfer, card, etc.]
- Your site goes live and the logins and domain are transferred to you once payment has cleared.
- If an invoice is not paid within 30 days I may take the site offline until it is paid. I will always contact you first and give you at least 7 days' notice before doing that.
- Anything outside the standard build is quoted separately in writing and you approve it before I start.
- Prices on this website may change over time. The price that applies to you is the price I quoted you in writing.
5.What is included
The standard $2,150 build includes:
- A complete website designed around your trade, your area and the work you actually want.
- Built to work properly on phones, tablets and computers.
- Your details, services, service area and contact buttons set up so customers can ring or message you in one tap.
- A contact or enquiry form that sends straight to you.
- Your domain name registered in your name (first year's registration fee included). See section 13.
- Hosting set up and configured. See section 14.
- Basic on-page search setup: page titles, descriptions, and your business details laid out so Google can read them.
- Every login and account detail handed over to you in writing.
- Free small edits for the first 6 months. See section 9.
6.What is not included
These are not part of the standard build. I can quote for most of them separately:
- Online shops, payment checkouts, booking or scheduling systems, customer logins or member areas.
- Ongoing SEO campaigns, Google Ads, Facebook Ads or social media management.
- Logo design and brand identity work. If you do not have a logo I will set your business name in type, which looks tidy but is not a designed logo.
- Professional photography or videography. I will use photos you supply and photos from your Google Business Profile where you have the right to use them.
- Professional copywriting beyond the site copy I write for the build.
- Email hosting or business email accounts. I can point you in the right direction.
- Fixing, migrating or maintaining a website someone else built.
- Paying for third-party services in your name on an ongoing basis, such as domain renewals from year two onward.
7.Timeframes
- Mockup: usually within 48 hours of getting what I need from you.
- Changes to the mockup or the build: usually within 24 hours.
- Finished site: usually within 1 to 2 weeks of you giving me the go-ahead and the content.
These are honest working targets, not guarantees. They depend on you getting me the photos, text and details I need. If I am going to miss one, I will tell you rather than go quiet.
8.Changes during the build
Changes during the build are included and there is no set limit on them. That is the whole point of "you do not pay until you are happy".
What is fair use: reworking the design, the wording, the photos, the layout, the colours, the pages and the structure until the site is right.
What is a new job, not a change: scrapping an approved direction and starting again from nothing for a third time, or asking for something on the "not included" list in section 6. If we get to that point I will tell you plainly, explain why, and quote it before doing any of it. I will never bill you for something you have not agreed to first.
9.Free edits for 6 months
For 6 months from the day your site goes live, small edits are free. Just ring or text me.

Free edits are for reasonable, occasional use. I have never turned a tradie down for asking too often and I do not expect to, but if requests reach the point of being a part-time job I will have a straight conversation with you about a care plan rather than quietly stop replying.
Anything broken because of a mistake at my end is fixed free at any time, not just in the first 6 months, and that is on top of your rights in section 19.
10.After the 6 months
Nothing happens automatically. Your site keeps running, you still own it, and no fee starts up on its own. You are never billed for anything you have not asked for.
After 6 months you have three options, and doing nothing is one of them:
- Do nothing. Your site stays up and keeps working. Your only cost is your domain renewal, paid to your registrar, not to me.
- Pay per change. $150 per small edit, no plan and no commitment.
- Site Care, $49 a month. Optional, month to month, cancel any time with no exit fee. Unlimited small edits done within 48 hours, your domain renewal handled, monthly backups, uptime monitoring and your Google Business Profile kept current.
The full detail is on the After Your 6 Months page. Site Care never starts unless you ask for it, and cancelling it has no effect at all on your website: you own it either way.
You can also change the site yourself or get anyone else to, because it is your site and you have all the logins.
11.Content you give me
- You need to give me accurate details. If your licence number, ABN, insurance claim or service area is wrong on the site, it is wrong because it was given to me that way.
- By sending me photos, logos, text or reviews, you are telling me you have the right to use them. Do not send me photos of jobs that are not yours, images pulled off Google Images, or another business's wording.
- If a third party makes a claim because content you supplied was not yours to use, that is on you, not me. That said, if I am the one who put something on your site that I sourced, that is on me.
- Any claim on your site has to be true. Licence numbers, "25 years experience", "fully insured", guarantees and review counts all have to be real. Making false or misleading claims to customers is against the Australian Consumer Law, and I will not put a claim on a site that I know is not true.
- I do not write fake reviews or fake testimonials, and I will not put invented ones on your site. Real reviews from real customers only.
12.Who owns what
- Before payment: the design, layout and code are mine.
- Once you have paid in full: the finished website, its design, its content and its files are yours. I transfer all my rights in it to you. You can move it, change it, hand it to another developer or bin it. No permission needed and no exit fee.
- Your own content, logo, photos and business name always stay yours. Mine never.
- I keep the right to reuse my underlying tools, code libraries, templates and general know-how on other jobs. What is yours is your finished site, not a monopoly on the way I build things.
- I would like to show your finished site in my portfolio and marketing. If you would rather I did not, just say so and I will not. No reason needed.
13.Your domain name
- Your domain is registered in your name, with your details as the registrant. You own it outright. This matters: if a web company registers a domain in their own name, they can hold your business hostage with it. I do not do that.
- The first year's registration is included in the $2,150.
- From year two, renewal is yours to pay, usually around $20 to $30 a year depending on the registrar and the domain.
- Domains have to be renewed or they lapse and someone else can take them. Keeping yours renewed is your responsibility once it is in your name. Set a reminder.
- Some domains, including .com.au, require you to hold an eligible ABN or business name. You need to keep that eligibility current or you can lose the domain.
- If you already have a domain, I will connect it to your new site instead. If it is held by someone else, you may need to ask them for access.
14.Hosting, uptime and third parties
- Your site is hosted on Cloudflare Pages, which is free at the scale a tradie site runs at. You are not paying me a hosting fee and I am not marking up hosting.
- I do not own or control Cloudflare, your domain registrar, Google, or any other third-party service. I cannot guarantee they will never go down, change their pricing, or change their terms.
- If a third-party service I have set you up on starts charging or shuts down, I will tell you and help you move. I will not just leave you with a dead site.
- I aim for your site to be up all the time, but I do not offer a guaranteed uptime percentage and I am not liable for outages caused by third parties.
15.Search rankings and results
I build your site so Google can read it properly, and I set up the basics correctly. I do not, and cannot, guarantee any particular Google ranking, any number of enquiries, any number of leads, or any amount of extra work. Nobody honest can. Google's rankings are Google's call, and results depend on your trade, your area, your competition, your reviews and your own follow-up.
Any figures on my website about how customers behave are published research from third parties, and are about people in general, not a prediction about your business.
16.If you go quiet
Builds stall when I am waiting on photos or details. If I have not heard back from you for 30 days after asking for something I need, I will treat the job as on hold and stop work.
Come back any time within 6 months and we pick up where we left off at the original price, no penalty. After 6 months I may need to requote, because the design system will have moved on. You will not be invoiced for a site you never approved.
17.Cancelling
- You, before you approve the site: cancel at any time, for any reason or none. You owe nothing. There is no deposit to lose and no cancellation fee.
- You, after you approve the site: the invoice for approved work is payable.
- Me: I may decline or stop a job if I am asked to publish something false, misleading or unlawful, if content supplied is not yours to use, or if I am abused or threatened. If I stop for one of those reasons, you owe nothing for unpaid work to that point.
- Either of us can end things by telling the other in writing (a text or an email counts).
18.The refer-a-mate offer
- If you refer another business to me and they go ahead with a paid website, you get $200.
- The $200 is paid once their site is live and their invoice has been paid in full.
- One $200 payment per referred business. There is no cap on how many different businesses you can refer.
- The referral has to be a genuine new customer who had not already contacted me, and they need to tell me you sent them.
- The referred business gets the standard price. Their site does not cost more because you get paid.
- I can change or end this offer at any time, but a referral you have already made is honoured on the terms that applied when you made it.
19.Your rights under Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, those guarantees mean services must be provided with due care and skill, must be fit for the purpose you told me about, and must be supplied within a reasonable time.
If a service is not delivered with due care and skill, you are entitled to have the problem fixed, and if it is a major failure you are entitled to cancel and get a refund, and to compensation for any other reasonably foreseeable loss or damage.
Nothing on this page limits or takes away those rights. Where any part of these terms conflicts with the Australian Consumer Law, the law wins and that part does not apply.
20.Limits on my liability
Subject entirely to section 19:
- Where I am allowed to limit my liability, I limit it to either redoing the work or refunding what you paid me, whichever you prefer.
- I am not liable for loss of profits, loss of business, lost enquiries or indirect losses.
- I am not liable for problems caused by third-party services outside my control, or by changes you or someone else makes to the site after handover.
- My total liability will not be more than the amount you have paid me.
This is standard for a one-person business. It is not me trying to dodge doing the job right. If I stuff something up, I fix it.
21.Privacy
How I handle your information is set out in the Privacy Policy, which forms part of these terms.
22.Changes to these terms
I may update these terms as the business grows. The version that applies to your job is the version on this page on the day you gave me the go-ahead, and I will not change the deal on you halfway through a build.
If I make a change that materially affects work I am already doing for you, I will tell you directly first.
23.If something goes wrong
Ring me first. Most things get sorted in one phone call. If it is not sorted that way, put it in writing to billy@hazewebsites.com.au and I will respond within 5 business days.
If we still cannot sort it out, you can take it to the Queensland Office of Fair Trading, or to the Queensland Civil and Administrative Tribunal (QCAT) for small claims. Neither of us gives up any legal right by trying to sort it out directly first.
24.Governing law
These terms are governed by the laws of Queensland, Australia. Both of us submit to the courts of Queensland.
If a court finds any part of these terms unenforceable, that part is cut out and the rest still stands.
