Terms of Service

These are the terms of working with Haze Websites. They are written in plain English on purpose. If anything here is unclear, ring me on 0447 132 774 and I will explain it before you agree to anything.

The short version

The mockup is free and costs you nothing to look at. If you go ahead, the site is $2,150 paid once. You do not pay until the site is finished and you are happy with it. The website and the domain end up in your name. Small edits are free for the first 6 months. There is no lock-in contract and no compulsory monthly fee. The rest of this page is the detail behind that.

1.Who you are dealing with

This website and service is operated by [LEGAL NAME TO CONFIRM: Billy Howard trading as Haze Websites, or the Pty Ltd name], ABN [ABN TO CONFIRM], of [BUSINESS ADDRESS TO CONFIRM], Queensland, Australia.

In these terms, "I", "me" and "my" means Haze Websites. "You" and "your" means the person or business engaging me. Contact: billy@hazewebsites.com.au or 0447 132 774.

2.When these terms apply

These terms apply from the moment you request a free mockup, and they keep applying while I build and hand over your website. They are the whole agreement between us, along with any written quote or scope I send you.

If a written quote I send you says something different to this page, the quote wins for that job.

Nothing here replaces a conversation. If you want something in writing before you commit, ask and I will put it in writing.

These are not part of the standard build. I can quote for most of them separately:

7.Timeframes

These are honest working targets, not guarantees. They depend on you getting me the photos, text and details I need. If I am going to miss one, I will tell you rather than go quiet.

8.Changes during the build

Changes during the build are included and there is no set limit on them. That is the whole point of "you do not pay until you are happy".

What is fair use: reworking the design, the wording, the photos, the layout, the colours, the pages and the structure until the site is right.

What is a new job, not a change: scrapping an approved direction and starting again from nothing for a third time, or asking for something on the "not included" list in section 6. If we get to that point I will tell you plainly, explain why, and quote it before doing any of it. I will never bill you for something you have not agreed to first.

9.Free edits for 6 months

For 6 months from the day your site goes live, small edits are free. Just ring or text me.

Free edits are for reasonable, occasional use. I have never turned a tradie down for asking too often and I do not expect to, but if requests reach the point of being a part-time job I will have a straight conversation with you about a care plan rather than quietly stop replying.

Anything broken because of a mistake at my end is fixed free at any time, not just in the first 6 months, and that is on top of your rights in section 19.

10.After the 6 months

Nothing happens automatically. Your site keeps running, you still own it, and no fee starts up on its own. You are never billed for anything you have not asked for.

After 6 months you have three options, and doing nothing is one of them:

The full detail is on the After Your 6 Months page. Site Care never starts unless you ask for it, and cancelling it has no effect at all on your website: you own it either way.

You can also change the site yourself or get anyone else to, because it is your site and you have all the logins.

I build your site so Google can read it properly, and I set up the basics correctly. I do not, and cannot, guarantee any particular Google ranking, any number of enquiries, any number of leads, or any amount of extra work. Nobody honest can. Google's rankings are Google's call, and results depend on your trade, your area, your competition, your reviews and your own follow-up.

Any figures on my website about how customers behave are published research from third parties, and are about people in general, not a prediction about your business.

16.If you go quiet

Builds stall when I am waiting on photos or details. If I have not heard back from you for 30 days after asking for something I need, I will treat the job as on hold and stop work.

Come back any time within 6 months and we pick up where we left off at the original price, no penalty. After 6 months I may need to requote, because the design system will have moved on. You will not be invoiced for a site you never approved.

19.Your rights under Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Among other things, those guarantees mean services must be provided with due care and skill, must be fit for the purpose you told me about, and must be supplied within a reasonable time.

If a service is not delivered with due care and skill, you are entitled to have the problem fixed, and if it is a major failure you are entitled to cancel and get a refund, and to compensation for any other reasonably foreseeable loss or damage.

Nothing on this page limits or takes away those rights. Where any part of these terms conflicts with the Australian Consumer Law, the law wins and that part does not apply.

20.Limits on my liability

Subject entirely to section 19:

This is standard for a one-person business. It is not me trying to dodge doing the job right. If I stuff something up, I fix it.

How I handle your information is set out in the Privacy Policy, which forms part of these terms.

22.Changes to these terms

I may update these terms as the business grows. The version that applies to your job is the version on this page on the day you gave me the go-ahead, and I will not change the deal on you halfway through a build.

If I make a change that materially affects work I am already doing for you, I will tell you directly first.

23.If something goes wrong

Ring me first. Most things get sorted in one phone call. If it is not sorted that way, put it in writing to billy@hazewebsites.com.au and I will respond within 5 business days.

If we still cannot sort it out, you can take it to the Queensland Office of Fair Trading, or to the Queensland Civil and Administrative Tribunal (QCAT) for small claims. Neither of us gives up any legal right by trying to sort it out directly first.

24.Governing law

These terms are governed by the laws of Queensland, Australia. Both of us submit to the courts of Queensland.

If a court finds any part of these terms unenforceable, that part is cut out and the rest still stands.
